Congress may well ban or restrict the short selling of stocks. Short selling is no different than the normal selling of shares of a stock, except that in this case, the investor borrows the shares, in the expectation that he can buy them back at a lower price when he returns them to the lender.
Why short selling ban is bad?
While it’s natural for policy makers to try to protect investors and markets, a ban on short selling is a terrible idea. They reduce liquidity and introduce confusion at a time when the smooth functioning of markets is critical. They don’t support stock prices; they prevent accurate price discovery.
When does the short selling rule come into force?
On 6 January 2021, the Treasury published the Short Selling (Notification Thresholds) Regulations 2021 No. 5 (the Regulations) to amend the notification threshold under Article 5 (2) of the Short Selling Regulation from 0.2% to 0.1% of the issued share capital of an issuer. This change comes into force on 1 February 2021.

To be able to submit a short selling notification to us on behalf of a position holder, the person making the notification (the reporting person) must be registered as authorised. If you are making notifications for yourself, you will still need to be registered as a reporting person beforehand.
