Paying parents who use the Collect and Pay service must pay a collection fee of 20 per cent of the child maintenance payment on top of the regular child maintenance. Receiving parents will have four per cent deducted from their regular child maintenance payment.

The Collect & Pay service is when the CMS works out the amount of child maintenance to be paid and collects payments from the paying parent and passes them on to the receiving parent. The paying parent will have to pay a 20 per cent collection fee each time a payment is collected from them.

The CMS can try to get the arrears from the other parent’s earnings, benefits, or bank or building society account. If that doesn’t clear the arrears, the CMS can apply to court for a ‘liability order’. This means they can ask bailiffs to take goods from the other parent and sell them.

The Child Maintenance Service can still enforce missed payments. Keep a record of payments in case there are any problems in the future. Either parent can choose Direct Pay without needing the other’s consent, unless there’s evidence that the paying parent is unlikely to pay.
