Even completing the Imperial Side of the Civil War doesn’t allow you to release Thorald. My guess is that Bethesda messed up on this quest and it’s bugged. Likely talking to the thalmor guard is supposed to change your quest marker to someone in Solitude who could pardon Thorald, but it doesn’t.
